1 Who we are and what this policy covers
Lintek Tracking Solutions Limited, trading as Escapade (Escapade, we, us or our), is responsible for the personal information described in this policy. This policy explains how we collect, use, disclose, store and protect personal information in connection with escapade.nz, our online store, customer service, marketing and related social-media interactions.
We handle personal information in accordance with the New Zealand Privacy Act 2020 and its Information Privacy Principles. This policy does not apply to third-party websites or services that have their own privacy policies.
Future connected products
This policy does not cover data produced by future connected Escapade products or services, including SkyFort location, GPS, connectivity, device, proximity or security data. Before those features launch, we will provide a separate product-specific privacy notice explaining what is collected, why, who receives it, how long it is retained and the controls available to users.
2 Personal information we collect
Depending on how you interact with us, we may collect:
Identity and contact details, such as your name, email address, phone number, billing address, delivery address and country.
Account and order details, such as products purchased, order history, returns, refunds, delivery instructions, preferences and account information.
Payment and transaction details, such as payment status, transaction identifiers and limited payment information. Full card details are normally processed by our payment provider and are not received or stored by Escapade.
Communications and content you provide, including enquiries, customer-service messages, reviews, survey responses and interactions with our social-media accounts.
Marketing choices, such as whether you have subscribed, unsubscribed or otherwise expressed a communication preference.
Device and website-use information, such as IP address, browser and device type, pages viewed, links clicked, referring page, timestamps, cookie or advertising identifiers and approximate location derived from an IP address.
Information about another person that you provide for a legitimate purpose, such as a gift recipient or delivery contact. You should only provide this information where you are authorised to do so and should make that person aware of this policy.
3 How we collect information
We collect personal information:
Directly from you when you place an order, create an account, subscribe, contact us, submit a review, enter a promotion or otherwise interact with Escapade.
Automatically through Shopify, cookies, pixels and similar technologies when you use our website.
From service providers and other sources, such as Shopify, payment providers, couriers, Google, Meta, referral partners and social-media platforms, where permitted by law.
Information collected from someone else
If we receive personal information about you indirectly, we will take reasonable steps to notify you as soon as reasonably practicable where the Privacy Act requires us to do so. That notice may explain that we hold the information, why it was collected, its intended recipients, our contact details, whether providing it was required or voluntary, the consequences of not providing it, and your access and correction rights. Legal exceptions may apply.
4 Why we use personal information
We may use personal information to:
Operate, administer and secure our website and online store.
Process payments, fulfil and deliver orders, provide order updates, and manage returns, refunds, warranties and customer support.
Verify transactions, reduce fraud, troubleshoot problems and protect customers, Escapade and our service providers.
Communicate with you about enquiries, purchases, products, service changes and other matters relevant to our relationship with you.
Send marketing communications where you have consented or where otherwise permitted by law.
Understand website performance, measure campaigns, improve products and services, and show or measure relevant advertising.
Meet tax, accounting, consumer-law, regulatory and other legal obligations, and establish, exercise or defend legal claims.
Some information is necessary to complete a purchase or provide a requested service. If you do not provide it, we may be unable to process an order, arrange delivery or respond fully to your request. Providing information for marketing is optional.
5 Cookies, analytics and advertising
Our website uses cookies, pixels and similar technologies. Some are necessary for core functions such as checkout, security, account access and remembering selections. Others may help us understand website use, improve performance, measure marketing or present more relevant advertising.
These technologies may be provided by Shopify and, where enabled, Google and Meta. They may collect device identifiers, online activity, IP address, browser information and interactions with our website. Google and Meta may combine information received through their tools with information they already hold, subject to their own privacy policies and your account settings.
You can manage non-essential technologies through any cookie banner or privacy controls made available on our website, through your browser settings, and through the relevant platform settings. Blocking some technologies may affect website functions. Your choices may apply only to the browser or device on which they are made.
6 Marketing communications
If you choose to receive marketing, we may contact you about Escapade products, launches, offers and stories. You can unsubscribe at any time using the link in a marketing email or by contacting us. Unsubscribing from marketing does not prevent us from sending service messages relating to an order, account, safety matter or legal obligation.
7 When we share personal information
We may share personal information only where reasonably necessary with:
Shopify, which hosts and supports our online store.
Payment processors, fraud-prevention providers and financial institutions involved in a transaction.
Warehouses, fulfilment providers, couriers and other delivery partners.
IT, cloud-hosting, security, customer-support, email and marketing service providers.
Analytics and advertising providers, including Google and Meta, where their tools are enabled and subject to your available choices.
Professional advisers, insurers, auditors, regulators, law-enforcement agencies, courts or other parties where required or permitted by law.
A prospective buyer, investor or adviser in connection with a proposed sale, restructuring or transfer of all or part of our business, subject to appropriate confidentiality arrangements.
We do not sell personal information for monetary payment. Some providers may process personal information for their own purposes under their own privacy terms, in addition to providing services to us.
Shopify
Our store is hosted by Shopify. Shopify processes customer information to provide, secure and improve its platform and enabled services. For more information, see the Shopify Consumer Privacy Policy.
8 Overseas processing and disclosure
Some of our service providers, including Shopify, Google and Meta, may store or process personal information outside New Zealand. Privacy laws in those locations may differ from New Zealand law.
Where we disclose personal information to an overseas person or organisation, we will comply with Information Privacy Principle 12. This may involve taking reasonable steps to ensure comparable safeguards, relying on another permitted basis, or obtaining express authorisation after explaining that the overseas recipient may not be required to protect the information in a way comparable to the New Zealand Privacy Act.
9 How we protect and retain information
We use reasonable administrative, technical and physical safeguards appropriate to the nature of the information we hold. These may include access controls, secure service providers, encrypted connections, monitoring and staff or contractor confidentiality obligations. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including to complete transactions, provide support, meet tax and accounting requirements, manage warranties and disputes, prevent fraud and satisfy legal obligations. When information is no longer required, we will take reasonable steps to delete it or make it anonymous.
Privacy breaches
If a privacy breach has caused, or is likely to cause, serious harm, we will notify the Office of the Privacy Commissioner and affected individuals as soon as practicable, as required by the Privacy Act.
10 Your choices and privacy rights
You may ask us to confirm whether we hold personal information about you and to provide access to it. You may also ask us to correct information you believe is inaccurate. We may need to verify your identity before actioning a request and may withhold information only where the Privacy Act permits.
You may also ask us to delete information or stop a particular use. We will consider the request, but deletion or restriction may not be possible where information must be retained for legal, accounting, transaction, safety or dispute-resolution purposes. Marketing choices can be changed as described in section 6, and cookie choices as described in section 5.
11 Children’s privacy
Our website is not designed specifically for children. We take extra care where we know personal information relates to a child or young person. If you are a parent or guardian and believe a child has provided personal information to us without appropriate involvement, please contact us.
12 Third-party links
Our website or communications may link to third-party websites, apps or social-media services. We do not control their privacy practices. Please review the privacy information provided by those third parties before giving them personal information.
13 Changes to this policy
We may update this policy when our practices, services or legal obligations change. The current version will be published on escapade.nz with a revised effective date. If a change is material, we may also provide a more prominent notice where appropriate.
